USER AGREEMENT
THIS IS A BINDING AGREEMENT between Luck Stone Corporation (“we,” “us,” or “our”) and any person (“you” or “your”) who submits content to the HARTRU.com website. Please read the entire Agreement carefully before submitting content.
BY SELECTING THE CHECK BOX AT THE END OF THIS AGREEMENT YOU EXPRESSLY AGREE TO BE BOUND BY ALL OF THE TERMS OF THIS AGREEMENT, REGARDLESS OF WHETHER YOU HAVE ACTUALLY READ THEM.
Submissions
You acknowledge that any submissions you make to the HARTRU.com website may be edited, removed, modified, published, transmitted, and displayed by Luck Stone and you waive any moral rights you may have in having the material altered or changed in a manner not agreeable to you.
By submitting content to the HARTRU.com website, you hereby grant to Luck Stone, its affiliates and related entities (collectively, Luck Stone) the royalty-free, perpetual, irrevocable, non-exclusive right and license to use, copy, modify, display, distribute and reproduce all such materials in any form, media, software or technology of any kind now existing or developed in the future. You also agree to indemnify, defend and hold Luck Stone harmless for any liability arising due to the use or distribution of those materials. You further grant Luck Stone the right to use your name in connection with the reproduction or distribution of such material.
Limitation of Liability
UNDER NO CIRCUMSTANCES WILL WE BE LIABLE TO YOU OR ANY OTHER PERSON FOR ANY LOSS OR INJURY, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL OR PUNITIVE DAMAGES FOR ANY MATTER ARISING FROM OR RELATING TO THIS AGREEMENT, THE SERVICE OR THE INTERNET GENERALLY, INCLUDING, WITHOUT LIMITATION, YOUR USE OR INABILITY TO USE THE SERVICE, ANY CHANGES TO OR INACCESSIBILITY OF THE SERVICE, DELAY, FAILURE, UNAUTHORIZED ACCESS TO OR ALTERATION OF ANY TRANSMISSION OR DATA, ANY MATERIAL OR DATA SENT OR RECEIVED OR NOT SENT OR RECEIVED, ANY TRANSACTION OR AGREEMENT ENTERED INTO THROUGH THE SERVICE, OR ANY DATA OR MATERIAL FROM A THIRD PERSON ACCESSED ON OR THROUGH THE SERVICE, WHETHER SUCH LIABILITY IS ASSERTED ON THE BASIS OF CONTRACT, TORT OR OTHERWISE, AND EVEN IF WE KNEW OR HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SOME STATES PROHIBIT THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, THUS THIS LIMITATION OF LIABILITY MAY NOT APPLY TO YOU. IF YOU ARE DISSATISFIED WITH THE SERVICE, YOUR SOLE AND EXCLUSIVE REMEDY SHALL BE FOR YOU TO DISCONTINUE USE OF THE SERVICE AND TERMINATE THIS AGREEMENT.
